Another Copyright Question

I've been hanging around the forum for the last few months trying to learn more about the sign business. We are a fabric awning manufacturer and have been decorating awnings for 25+ years. We silk screen, mask and spray, use vinyl and about 4 months ago purchased a Jv33-160 printer. Up until now we normally just supplied simple lettering. Any logos we used were the property of the customer or they had the rights to use them. Since we got the printer we decided to offer making banners for customers.

Finally, here's my question.

A customer wants me to make a banner for them. They are going to the race at Bristol. The banner is to say "Bristol Bound Baby". They also want me to put the #88 on the banner. Are the numbers of the cars copyrighted? How about the National Guard logo?

Never been to a Nascar race but I'm guessing there will be co reps there that may see that banner and have an issue with it

Do you think the reps would confiscate a fan's banner that had a driver's number on it?
I'd like to see that on TV......
Yes, technically it's copyrighted, but unless the guy brings banners to sell to other fans I think he'll be fine.

It's not a copyright issue; it's a trademark issue. Using a logo sans permission is classic trademark infringement.

Typically what happens is nothing. Next most typical is they send a cease and desist; you should.

In rare cases, where damages can be measured, monetary awards are granted in court.

That makes it simple.No 88. I told the customer that it might not be possible when I talked to her originally.
