Finally, we have a lucky break???

We are responsible for everything inside of our rented space. Landlord only pays for roof and a few exterior issues (what's that called, triple net?). We just moved (next door) because it had a larger hvac system which would allow us to have more conditioned space. Part of the agreement is that they come in and have the HVAC system inspected prior to us moving it. Once it's checked off, it's our baby, with a cap on the limit we could ever spend. But if we move in on Tuesday and on Wednesday, the system craps out, it's a pile of cash out of our pocket, which sucks, but it's the way it is.

So prior to moving in, we paid our hvac guy to come in and do a complete inspection. He noted the system was 33 years old and the problems were great. I had a long list of issues.

So we move in, no inspection. We wait, no inspection. We call them and ask when it's going to be inspected and they tell us the inspection "slipped through the cracks" and they'll send someone out.

The guy shows up and starts checking and he's basically saying the unit is fine. So I whip out my list and say "Did you check this? That? What was the reading here? Etc.". I tell him we already know what's wrong with it because we had it inspected. He slowly starts to document the things I bring up.

He comes to me at the end of his inspection and says that I have put him in a bad spot. He was basically sent to "find nothing". He won't say that, but he said that he had to document on his findings that we guided him to things to check based on a prior inspection by a 3rd party.

All is quiet, we're hearing nothing back, so we start following up on it.

Well, they are here today and tomorrow, putting in a brand new 4 ton heat pump, no cost to us!

First lucky break we've had with this landlord yet. That's an easy $12,000 from what they are telling me.

So it's hot as hell in here today (and tomorrow), but each drop of sweat makes me smile a little :)
 
good stuff! makes me pissed when landlords try to take advantage of clients knowing full well there are responsable for stuff and don't care either way. good on you!

gotta love it when a plan comes together. Would loved to have seen the look on your landlords face after speaking with his HVAC guy. LOL

We spent $100 on the inspection by our guy. Had we not done that, their "vendor" would have walked in, checked a few things, and walked out, saying "looks like it's working to me".

Best $100 we spent in our existence :)

When I first moved to commercial space 10+ years ago, a client was a commercial real estate broker. He told me to never, ever, ever agree to be on the hook for the full cost of the system and to walk away from the deal if they wouldn't agree.

I did not use him to represent me on future deals, but have held strong on this on 4 leases since. Several of those were in much better times than we have now, and they still agreed.

It saved me once already at that first place. $3000+ to replace thier unit, glad I didn't have to pay that. My current lease has a $250 per year cap on HVAC expenses that I pay.

Great point. Our Realtor did the same thing for us. It's not as good as yours, but it's a long way from the cost of the new system. He told us that very few people ever write that into contracts and he advised all his customers to write it in. We're in a place with a fairly lost cost per sq. ft. so the ability to "deal" is very limited. We asked them to replace carpet in the front office because it had a massive tear in it. They said "No". They finally came back and said the rent would go up $3,000 a year if we wanted new carpet. We did it ourselves for less than $500.

That's one thing I hate, when you're at the bottom of the food chain, it's not a lot you can negotiate with. Our landlords attitude is "Don't like it, find somewhere else", but it's a great location for us, so we take what we can, and in this case, we took a lot :)

thats the oldest trick in the book. stupid landlords. they have all tryed to do it to me except one.

that little clause that says that you are responsible for ALL repairs to their 9734987234987239487239487239847 year old hvac unit. you know the one. the one that has NOTHING wrong with it when you move in in the winter, then you go to turn it on in the summer and it doesnt work AT ALL.

god i hate snake in the grass landlords sometimes. great to hear you did the smart thing, and stuck it to yours.
