How can you patent...

So.. I know there will be some drama on this post- But I have to throw this out there.
How do you patent something.. that's already patented?

For instance.. I LOVE my knifeless tape. But seriously.. How can they patent something that was already patented in 2000 by Langeman? Langeman practically invented this stuff for use on Bedliners. See for yourself the patent Click here and product also here
I must only mention this because I noticed ads about "Don't use the others knock offs." by knifeless.

So... who really has the knockoff.... Knifeless or WrapCut ??

The one that will have the patent is the one with the bigger legal budget - it's the best way to ensure ONE version of the truth

and you can also patent the process which might come into play on a product such as this.

Doesn't take much to patent something. In this case, the recipes for the vinyl, the glue, how the glue is adhered to the vinyl are all variables that can be patented. Right there, there is enough for 3 different patents, for each company.

Even now, a third company could take one of these patent, lets say the glue, change the recipe and have IT patented.

Patents mean nothin' !

i'd say patents only mean something if you are a multinational corporation. if a guy forks over $5k to get something patented, he's wasted his money. unless he's willing to later spend potentially millions to defend that patent and also have that patent trampled on in other countries. that's not to say that he won't win in court and be awarded for patent infringement. but in order to get that point a year in court and a few hundred thousand in legal bills would be needed.

On another Website I visit has a patent law suite that took six years and the company that the suite was against has since been sold and now out of business. So the patent holder has gone to ebay and had all sales of the equipment pulled due to patent infringement! So the people who unknowingly purchased this equipment are now having problems trying to sell them! So the patent holder now has legal fees he most likely will never recoupe.

A quick search will show that Knifeless was first referenced on Signs101 back in January 2011 when we released our products to the market.

We would like to assure you that our patents for Knifeless Tape products are in good order and that they pertain to the use of our tapes specific to cutting all films with a sticky back. Other patents related to trimming of sprayed on truck box coatings or otherwise have no bearing on this application as our tape was specifically designed for the purpose of cutting films with a sticky back and not coatings. Also please take note that two patent examiners in two different countries have granted our patents and were fully aware of all other patents pertaining to the use of a filament with tape.

Further, we want to assure you that our products have been tested by all the major film manufacturers for whom we continue to provide training and market support. Knifeless Tape has been designed by a wrapper for wrappers, keeping in mind all the material and performance details required for our industry.

The patent system as it stands now is an absolute joke. You could probably patent each new deposit you make in the morning at the toilet as a form of methane production. The patent office would probably accept it for every new kind of food composition that went into the production of said gas.

I deal with a patent holder that attacks his own legal users and then ignores copycat competition. He does this because, "it is his right to go after whom he chooses and it would cost an arm & a leg if he went after every infringement." Basically it brings him money by barking at legal users and would cost him money to protect them (which he doesn't).

wait a minute.
people have been using a line to cut for a long time. Ever since I remember its been piano wire for certain jobs..
Remove mirrors etc.,
Apply paper with a filament spray over it and cut a clean line by pulling the wire or string. Apply vinyl over a fine string and pull that string to cut the vinyl. Been doing that for years.
What is this new thing? Somebody patented cutting with a string or a wire?

Patents are funny things. Monsanto, spelling is probably wrong , anyways they patent a Canola seed they developed. The seed has animal DNA mixed in it, so Roundup cant kill it. That's cause Roundup only works for plants not animals. Canola likes to blow all over the place like tumbleweed. You gotta pay extra premium can't afford price from Monsanto, to buy poison to kill it.

Farmer gets the animal DNA canola seed blown into his field from the neighbors, there is no fences here. Farmer sells his canola seed and there is 20% genetic engineered seed from Monsanto Patented DNA Seed in his crop. Blow ins for several years, I guess, grows better than farmers seed.

So Monsanto has big lawyers they go after the small farmer for steeling the Patented DNA modified seed. Small farmer for eternity has to pay Monsanto 20% for the crop he produces of pay 50% of his crop to poison the fields. Something that will only last a few years. The small farmer can't kill off the DNA modified Canola cause nothing will kill it for a reasonable price, nothing the farmer can afford anyways.

Soon enough Mansanto owns all the small farms for miles. Patent seed puts farmers into bank-cropsy, farmers going under all over the place. Horror story in the making? That's the start, soon many people find they can't use the canola oil for frying food, some kind of allergic reaction. Worse reaction from the exhaust fumes in diesel trucks using it as fuel. Cumming to a farm near you.

The Mixed genetics is every where, from the farms of Canada to the swamps of Disney. Canola isn't the only crop meddled with they have a expansive genetic engineering department. When will the big mistake happen, or has it already.

Sorry a little off topic, but that's the patent office for you.

For what its worth Josh... You can patent something that has an existing patent if it is an improvement on the existing design that IS NOT obvious.
