It's not alright in war, but there isn't always a choice. Collateral damage is a give in, BUT they do everything in their power to prevent it, don't they? Theres rules of war / engagement... If bin laden was in a school and there were 5 kids in the school, but USA said Whelp... We can bomb the school, it'll save thousands of lives, those kids are worth it... They'd be committing a war crime, and there would be punishments for their action. If Bin laden was in a school after hours, they were watching the school and believed it to be empty... And sent a bomb to blow up the school, And found out halfway through the missile being launched that there were children... Do you think they'd say oh well, too late, and let it go? Legally and morally that'd be wrong of them to do. It'd make USA no better than the guy they were trying to kill.
You're half right. In my mind, it's not an either or - It isn't let the 1 tree burn so the forest can survive... it's do whatever you can to save the 1 tree, even if it means the forsest has to wait 30 minutes for me to go dig the one tree out, or spend hundreds, or thousands, or whatever it is to save the tree (Assuming the tree is a person, I wouldn't save a non hypothetical tree). If They turned the plane around like they were ordered to, what would the harm be? Drop garcia off... and send the plane off again. Deport him to another Country if the only issue is the country he was being deported to. My tax dollars go towards so much useless shit, I'd be more than happy if some of it went to ensuring everyone got a fair trial.
America was built on founding principals, principals that are supposed to mean something - This isn't just about Garcia, it's about the whole system. It's taken hundreds of years to get to where we are law, and policy wise... Why can we just throw it out the window and ignore the courts...Even if you think they have no authority over the president or DOD.... then how is it ok to ignore the supreme courts? You're ok with whats happening so you don't mind that Trumps taking a dumb and bypassing the courts... but what if all of a sudden someone else is elected, and decides revolvers are good enough to satisfy the 2nd amendment, and every other gun is illegal and they start rounding up all the guns? Throw out all the past court precedent, all the checks and balances that were placed, and executive order his way or ignore the courts to get his will done? Yeah... it seems crazy and hyperbolic like it'd never happen, but 5 years ago, 10 years ago, no one ever thought a president would ignore a judges or supreme judges rules.
